The rules really are as clear as that, the only reason the Aussie articles say that Marshall wouldn't count on the cap is lazy journalism - I can post the "new talent pool" rules here if you would like to dissect yourself but the take away is to qualify a player must have never played league before. Marshall, eastmond and tomkins do not qualify, and thus would require special dispensation from the rfl.
If J Tomkins came back to league however he would qualify for any and all home grown dispensations that may (should) get voted in
